Avenue’s
Local Phone Services provides local phone service only.
All phone service
unless otherwise stated from Avenue Phone services
will be blocked from all 900/976 calls, 1 + long distance,
local long distance, any pay per use features, and
any
0 + acceptance. Any use or acceptance of the above
or any use or acceptance of any service which incurs
charges
will be charged to the customer of Avenue Phone Services
at its own discretion may disconnect service without
notification.
- Your phone number will be listed unless anonymous number
is requested at time of your sign-up (Charges may apply).
- Your initial payment includes a one time non-refundable
fee ($49.95 plus tax) this covers our administration and
other costs associated with the preparation of your new
line for installation.
- Avenue's Local Phone Service requires 30 days notice
to cancel service. Any requests made to disconnect or remove
services without 30 days notice will result in forfeiture
of all monies paid.
- There are no refunds after service is installed unless
30-days notice is received
- Avenue’s Local Phone
Services cannot guarantee any phone number until the
number is installed at the customers
location.
- All payments to Avenue’s
Local Phone Services must be in the form of a certified
cheque or money order. Personal
cheques will not be accepted.
- Bills will be issued on the
15th of each month for the following month. All bills
are due in full on the first
of the month. If payment is not received by 5 p.m. on the
3rd of the month a late fee of $10.00 will be applied and
if payment plus late fee is not received in full by the
6th Avenue’s Phone Services will DISCONNECT service
and you will be subject to the reconnection fee.
- You can reconnect service upon completion of a new application
to restore services and paying any past due amounts or
fees.
- There is no guarantee you will retain your previous phone
number if your service was disconnected.
- Do not call Bell Canada (310-BELL)
for any reason regarding your service. Your service is
only with Avenue’s
Phone Services. All enquires and changes are to be made
directly with Avenue’s Local Phone Services.
- Avenue’s Local Phone Services will not be held
responsible for temporary outages in service which are
not controllable by Avenue’s Local Phone Services.
- Avenue’s Local Phone
Services reserves the right at its own discretion to
refuse service or discontinue
service to any customer.
- Any billing disputes or changes
are to be sent to Avenue’s
Local Phone Services. All disputes must be in writing with
a copy of the bill and must be received within 15 days
of the first billing date.
- Avenue’s Local Phone
Services reserves the right to change pricing without
notification.
- Any and all information received
by Avenue’s Phone
Services will become the property of Avenue’s Local
Phone Services.
- Electronic payments via the Internet and Telebanking
may take up to 3 (three) business days to reach our office.
Therefore should payment be made via Internet banking and/or
Telebanking and not received in our office before 5pm on
the 6th of the month disconnection will occur automatically.
*Flat Rate Long Distance Service Terms and Conditions
The Service
ALPS is proving a flat rate service, to the customer, that
is accessed by dialing a local telephone number. Customer
can talk as long as they want, as often as they like and
their monthly fee will not change. There are no per minute
charges and the customer can keep their present long distance
provider.
Network Uses
Service may be used for voice and fax only. NO INTERNET ALLOWED
USING OUR SYSTEM.
Line Requirement
Customer must have touch-tone service.
Termination of Service
For customers paying monthly, 30 days notice by mail is required
to cancel the service. For customers choosing the YEAR
IN ADVANCE or POST DATED CHEQUES options, termination of
service falls on the date of renewal unless service has
been renewed prior to that date.
Liability
In the event of an interruption in your ALPS service, except
as explicitly stated in this agreement, ALPS makes no warranties
and conditions, express or implied, including any implied
warranty or condition of merchantability or of fitness
for a particular purpose. In no event shall ALPS be liable
for consequential or exemplary damages, including lost
profit, or damages for personal injury, whether arising
out of breach of warranty, breach of contract, or otherwise,
and regardless whether such damages were or should have
been foreseen. The total liability of ALPS shall in no
event exceed the amounts paid by the customer to ALPS under
this contract.
Indemnity
The Customer shall indemnify ALPS against all claims, losses
or damage arising from the use of the Service provided
pursuant to this contract (or prior to this contract),
including without limitation, previous telecommunication
services, claims for libel, slander, invasion of privacy
or infringement of copyright’s and claims for patent
infringement arising from combining or using the Service
provided by ALPS and the Customer shall indemnify ALPS
against any claims, losses or damage that may arise as
a result thereof.
Confidentiality
Unless the Customer consents in writing or disclosure is
pursuant to a legal power, all information kept by ALPS
regarding the Customer, other than the Customer’s
name, address or listed telephone number is confidential
and may not be disclosed by ALPS to anyone other than the
Customer, its agents, representatives or employees.
Returned Bank Items
An administration fee of $15.00 is due on all returned items
(i.e. NSF cheques, stop payments, accounts closed, etc.).
Customers will be notified by letter, email or fax of their
returned payment. After 15 days, if payment is not received,
service will be discontinued.
